Overview

Kristen Hilton takes a common sense approach to helping clients resolve their business disputes.  Her practice is focused on complex civil litigation and employment matters including contract disputes, false advertising and unfair competition cases, partnership disputes, and business torts. For more than ten years, Kristen has represented large and small businesses in the technology, real estate, construction, entertainment, insurance, and health care industries, among others. Kristen handles cases through trial and appeal in state and federal court and in alternative dispute resolution forums. Kristen also uses her litigation experience to counsel businesses and employers on best practices to minimize future risk.

Kristen has also worked extensively on a wide range of pro bono matters.  In one matter, she tried a civil rights and medical malpractice case before a jury in federal court.  In another matter, she represented a group of Alaska Native voters in their lawsuit against the state of Alaska for violations of Section 203 of the Voting Rights Act. 

Prior to joining Sussman Shank, Kristen practiced at two large international firms in Santa Monica, California.  A native Oregonian, Kristen enjoys spending time with her family and giving back to her community through her work on the Campaign for Equal Justice and as a member of the Oregon Coast Aquarium Board of Directors.

Representative Matters
  • Represented national law firm in federal jury trial related to promissory note.  Assisted in obtaining directed verdict dismissing plaintiff's claims against our client, and awarding damages and attorneys' fees to our client based on its counterclaim.
  • Defeated motion for temporary restraining order against insurance broker for alleged violations of non-compete and non-solicitation provisions in contract with his former employer.
  • Second-chaired an administrative proceeding in which we successfully defended industrial contractor against liquidated damages and debarment claims brought by county.
  • Part of a team that represented Grupo Televisa S.A.B., the world's largest Spanish language media company, in a three-year litigation against Univision Communications Inc.; the case settled favorably for Televisa three weeks into trial. 
  • Won dismissal of competitor lawsuit against industry leader in the manufacture of rubber liners and tubing used in the milking of dairy cows.  The complaint asserted claims for false advertising under the Lanham Act and unfair competition based on violation of California's Sherman Act. 
  • Successfully defended a medical product company in product labeling and trademark dispute involving claims for false advertising, false designation of origin, and false patent marking.
  • Negotiated settlement of copyright dispute between two software companies.
  • Represented medical billing company in seeking enforcement of non-compete agreements with former employees. 
  • Part of a trial team that represented state agency in 5-week jury trial of dispute with energy supplier stemming from the California energy crisis. 
  • Defended bank against claims brought by filmmaker regarding production loan.
  • Represented managing partner in dispute related to multi-million dollar commercial building.
     
  • Successfully defended a law firm against malicious prosecution claims brought by a real estate company and individual investors.
